		<description><![CDATA[The release of <a href="http://www.nytimes.com/2008/11/07/world/europe/07georgia.html?_r=1&#38;scp=1&#38;sq=osce%20georgia&#38;st=cse&#38;oref=slogin">the OSCE report</a> which disputes Georgia's claims about the start of the August invasion by Russia has obviously caused quite a stir, and started a whole new series of arguments from some unwitting pro-war apologists among American liberal camps (<a href="http://tpmcafe.talkingpointsmemo.com/2008/11/10/was_georgia_a_neo-con_conspira/">case in point</a>), seeking to push the new president-elect Barack Obama far clear of Russia's reclaimed "sphere of influence."  Melik Kaylan has <a href="http://www.forbes.com/opinions/2008/11/10/georgia-russia-obama-oped-cx_mk_1111kaylan.html">a good piece</a> which clarifies some of the problematic thinking going on over the Russia-Georgia issue in light of the new reports, and reminds us not to overestimate either the influence of Mikheil Saakashvili in the Bush White House, nor underestimate the incompetence and disinterest of the Bushies in undertaking such Machiavellian fantasies abroad.

<blockquote>There is an additional misconception that underlies much of the programmatic left/right, Democrat/GOP, détente/Cold War binary thinking on the matter: that the Bush administration encouraged Saakashvili to confront the Russians or at least bolstered his sense of allied support.

This is manifestly untrue. Tbilisi insiders told me that Georgia had been asking the Bushies for anti-aircraft missiles for some years. The Bushies consistently refused. Georgia had managed to acquire some from Israel, but the supply abruptly stopped in early summer this year--nobody knows why but it's likely that the Russians had a conclusive word with Israel. The Russkies regularly overflew Georgian territory as constant provocation, dropping a stray bomb here and a missile there, by mistake, in open countryside.</blockquote>]]></description>

<blockquote>Obama and Medvedev would do well early in their relationship to make some policy decisions that would sharply break with Cold War patterns. For example, although Obama would not have assumed command of the U.S. military when Russia's naval flotilla completes its exercises off Venezuela in mid-November, he could suggest that the Pentagon invite the Russian commanders to stop off at Central Command in Florida before their return to Russia. The purpose of the stop would be to discuss urgent issues that are engaging both navies, such as the piracy that is running rampant off Somalia.

And Medvedev, although he would have to push back against Kremlin hard-liners, could recommend that Moscow and Washington have some urgent issues to work on together with Tbilisi. Smuggling through South Ossetia has been a persistent problem, and it has at times involved that most dangerous of contraband -- fissile material that could be used to make nuclear bombs. Both Georgia and Russia have cooperated with the United States to build defenses against nuclear smuggling, and all three could cooperate to confront this terrible problem.

These two examples show clearly what must be done to get beyond the Cold War. They convey that Russia and the United States can cooperate rather than compete, even in their own backyards. Since Obama and Medvedev are so clearly of a new generation, they are the leaders who may finally succeed in breaking the old patterns.</blockquote>]]></description>

		<description><![CDATA[<strong>The Irish Times</strong><br /><br />JASON CORCORAN in Moscow <br /><br />Saturday, October 11, 2008<br /><br />EU MONITORS in Georgia have confirmed that Russian forces have dismantled 17 checkpoints, one signals post and one military base in zones adjacent to breakaway regions Abkhazia and South Ossetia.<br /><br />But, while EU foreign policy chief Javier Solana said yesterday Russian troops have completed their withdrawal from the areas in line with yesterday's deadline,French foreign minister Bernard Kouchner complained that Russia still occupies three disputed pockets of land - Akhalgori and Perevi in South Ossetia, and the Kodori Gorge in Abkhazia - areas that were under Georgian control before hostilities broke out.<br /><br />Col Dorcha Lee, a former army officer and veteran of UN peacekeeping missions in Lebanon, the Middle East and Serbia who heads the Irish group in the 200-strong European Union Monitoring Mission (EUMM) admits that their work is difficult and breaking new ground. "This is a new experience for the EU and we are hyper-sensitive to its needs and to succeed here. We hope to use this as a future model for conflicts if it works. It's a question of confidence-building so refugees can feel safe returning home and our presence is vital in that respect."<br /><br />The other members of the Irish group are Peter McMahon, a former Air Corp lieutenant colonel, Peter Emerson, a Russian speaker and lecturer in consensus politics, and Eithne MacDermott, a East European studies specialist.<br /><br />The Irish peacekeepers have travelled on patrol in armoured vehicles up the eastern side of the South Ossetian buffer zone from their field office at Bazaleti.<br /><br />The EUMM is scheduled to last a year and the Irish representatives are on a four-month stint.<br /><br />EU monitors began witnessing Russian troops bulldozing checkpoints and withdrawing since earlier this week.<br /><br />The Irish group were visited by the Irish Ambassador to Georgia, Geoffrey Keating, who also saw the main refugee camp in Gori where 3,000 displaced citizens are waiting to return home. He witnessed the delivery of food donations organised by Irish expat Dr Mike McCarthy and local Irish businessmen.<br /><br />Mr Keating, also Ambassador to Bulgaria, is based in Sofia. Overall, the Irish people and Government have contributed €250,000 in humanitarian assistance following the recent conflict. Georgian dignitaries today propose to protest to the European Union about <em>“violations of the Sarkozy-Medvedev agreement by Russia.”</em> Tbilisi has <a href="http://www.kommersant.com/p1030193/Russia_Georgia_South_Ossetia_conflict_ceasefire/">stressed</a> that the agreement was violated in the village of Khurcha, a region near the border with Abkhazia, where one Georgian policeman has died and two were wounded in gunfire issuing from as of now unknown sources.  Shota Utiashvili, head of the Georgian Interior Ministry information department, told Kommersant that<em> "on Sunday night, a diversionary group crept up to the village from the direction of the Russian checkpoint located nearby and it opened fire with snipers rifles, machineguns and grenade launchers."</em>

Ruslan Kishmaria, Abkhazian presidential representative in Gali District, responded in stating that <em>"this was an internal Georgian clash and the Abkhazian side has no relation to it.”
 </em>

Watchdog Transparency International <a href="http://www.guardian.co.uk/business/feedarticle/7819191">said</a> on Tuesday that corruption in Russia is at its worst for eight years, stoking investor fears just a week after Russian markets suffered their biggest losses in nearly a decade.

The annual survey issued by the Berlin-based watchdog put Russia in 147th place alongside Bangladesh, Kenya and Syria.]]></description>

Georgian dignitaries today propose to protest to the European Union about <em>“violations of the Sarkozy-Medvedev agreement by Russia.”</em> Tbilisi has <a href="http://www.kommersant.com/p1030193/Russia_Georgia_South_Ossetia_conflict_ceasefire/">stressed</a> that the agreement was violated in the village of Khurcha, a region near the border with Abkhazia, where one Georgian policeman has died and two were wounded in gunfire issuing from as of now unknown sources.  Shota Utiashvili, head of the Georgian Interior Ministry information department, told Kommersant that<em> "on Sunday night, a diversionary group crept up to the village from the direction of the Russian checkpoint located nearby and it opened fire with snipers rifles, machineguns and grenade launchers."</em>

Ruslan Kishmaria, Abkhazian presidential representative in Gali District, responded in stating that <em>"this was an internal Georgian clash and the Abkhazian side has no relation to it.”

Watchdog Transparency International <a href="http://www.guardian.co.uk/business/feedarticle/7819191">said</a> on Tuesday that corruption in Russia is at its worst for eight years, stoking investor fears just a week after Russian markets suffered their biggest losses in nearly a decade.

The annual survey issued by the Berlin-based watchdog put Russia in 147th place alongside Bangladesh, Kenya and Syria.]]></description>

Case in point, I've exchanged a few emails with a reader from Tbilisi, who has notified me of some interesting events happening there this week, concerning not Russia's military activities in the country, but rather the businesses and economic interests which piggybacked across the border with the tanks to begin conducting business within Georgian sovereign territory, yet not officially subject to its legal jurisdiction or regulatory oversight.

We report this here because it may be of interest to many of our international law readers who are interested in jurisdictional and regulatory questions in the context of invasion and occupation.

Today at a press conference, Giorgi Arveladze, Chairman of the <a href="http://www.gncc.ge/">Georgian National Communications Commission</a> (photographed), announced that his agency has issued a fine of more than $350,000 (500,000 Georgian Lari) to the Russian mobile phone operator <a href="http://eng.megafon.ru/">MegaFon</a>, which stands accused of illegally operating on the Georgian radiofrequency spectrum without a license.  According to <a href="http://www.robertamsterdam.com/megafon%20ENG.doc">the press release</a> from the Commission, MegaFon had previously been operating without license in several areas of South Ossetia, but expanded this coverage following the invasion.

The release also comments that "<em>The Commission also draws attention at the circumstances that, considering the “Megafon”’s economic intervention during the open and direct Russian occupation since August 7, 2008, the company might be involved in the Russian political and military plans. We believe that the illegal and unjustified participation of the private company in the political events is unacceptable and reprehensive.</em>"

Now it looks like Asia, led by Beijing, is pumping money into Tbilisi.  Yes, that's about the exact opposite outcome the Kremlin was looking for...

<blockquote>The Asian Development Bank, in which China plays a leading role, has extended a $40 million loan at the lowest possible rate to Georgia. The Shanghai Cooperation Organization - which includes China, Kyrgyzstan, Kazakhstan, Tajikistan, and Uzbekistan as well as Russia - refused to countenance Russia's recognition of two breakaway regions of Georgia. The rebuff of Putin is all the more striking because - at least from Putin's perspective - the central purpose of this group was to form an eastern counterweight to NATO.

China and the Central Asian states may share the Kremlin's resentment of American dominance in the world, but they are not so eager to construct a multipolar world that they will act against their national interests.</blockquote>]]></description>

Today, Gideon Rachman (who back in April <a href="http://www.robertamsterdam.com/2007/04/gideon_rachman_on_russia_and_g.htm">predicted the war</a>) mentions the visa issue as well in <a href="http://www.ft.com/cms/s/0/09342542-7e08-11dd-bdbd-000077b07658.html">the Financial Times</a>.  Doesn't anybody remember <a href="http://www.robertamsterdam.com/2008/05/russias_football_diplomacy.htm">how kind Russia was</a> with visas for British citizens for the Champion's League match?  Ah, it seems that an invasion and occupation can very quickly erase such small gestures of goodwill.

<blockquote>The Russian governmentâ€™s reluctance to occupy Tbilisi shows that there is still a debate going on in Moscow about how much international opprobrium the country can afford. Half a trillion dollars was wiped off the value of the Moscow stock exchange in the aftermath of the invasion of Georgia. 

The wealthy, Kremlin-connected elite would like to retain the privilege of having bank accounts in Switzerland, houses in London and tanks in neighbouring countries. It should not be too hard to suggest that there is a choice to be made. A crackdown on visas for Russian businessmen would be a good signal. </blockquote>]]></description>

Russia's recognition of Georgian breakaway regions South Ossetia and Abkhazia has increased backing for Georgia and Ukraine's admission to the 26-member NATO alliance, stated the official, who wished to remain anonymous. These statements were made as US Vice President Dick Cheney held talks with Italian leaders.

Cheney last week vowed Washington's backing for Baku, Tbilisi and Kiev during a tour of the region, and urged NATO to unite in order to ward off a return of "line-drawing" in Europe.

He held weekend meetings with political and business leaders at a conference in Italy, including many of the top world oil executives.

The official went on to state that the crisis in the former Soviet regions are "<em>not just a US problem; all of Europe has a stake in how this is handled and whether or not these sovereign independent states remain free and independently sovereign states</em>".]]></description>

Not long ago I somewhat <a href="http://www.robertamsterdam.com/2008/08/russia_feeling_lonely_after_88.htm">jokingly predicted</a> that the foreign desk at the Kremlin was having a really tough time choosing which surrogate state they should nudge into joining them as the second state to recognize the independence of Georgian territories Abkhazia and South Ossetia.  Well it seems that the clumsy footrace back to the Soviet past <a href="http://www.iht.com/articles/2008/09/04/america/georgia.php">was won yesterday</a>, as the dark horse Daniel Ortega, the Sandinista president of Nicaragua, beat out his <a href="http://www.alertnet.org/thenews/newsdesk/L10326187.htm">good friends</a> Hugo Chavez and Mahmoud Ahmadinejad.

Isn't it a little problematic for Mr. Ortega, as a former guerrilla fighter and leader of a country which was occupied by the Marines from 1912 to 1933 and torn to shreds by brutal Contra militias funded by Washington, to endorse the invasion and occupation of Georgia?  One would think Tbilisi and Managua would be natural allies for the defense of sovereignty and non-intervention for small democracies.]]></description>

The <a href="http://online.wsj.com/article/SB122038155757091699.html?mod=googlenews_wsj">Wall Street Journal</a> is carrying a story on VP Dick Cheney's trip to the Black Sea to express support for Georgia and push for alternative pipeline projects such as Nabucco.

<blockquote>"The Russians have demonstrated they can close that corridor through Georgia any time they want," said John Bolton, President Bush's former U.N. ambassador.

U.S. officials reject that. "The Georgian energy corridor is safe," Deputy Assistant Secretary of State Matthew J. Bryza, one of Nabucco's major supporters, told an audience in Brussels Monday. He stressed that Baku-Tbilisi-Ceyhan and the South Caucasus Gas Pipeline, which transports Azeri gas to Turkey, were unaffected by the fighting.

Mr. Bryza also said European energy companies behind Nabucco and the Turkey-Greece-Italy pipeline have told him they are determined to proceed with the two projects. "They haven't slowed down at all," he said. "They are anxious to line up gas supply contracts with Azerbaijan as soon as possible."

But some analysts said the Georgian war could scare off investors, making it hard for the consortium to raise the €7.9 billion ($11.5 billion) needed to build Nabucco -- a task already complicated by the global credit crunch. Plans to expand Baku-Tbilisi-Ceyhan's capacity may also be in jeopardy.

"This increases the risk profile enormously," said Jonathan Simpson, head of European projects at international law firm Paul Hastings. "Without the EU and the U.S. stepping in and subsidizing them, they won't get built. And so far they've shown no inclination to do that."</blockquote>]]></description>

Listen to what Putin's puppet president, 42-year-old former corporate lawyer Dimitri Medvedev, told the BBC this week: Russia's invasion of Georgia was spurred by the "genocide" in South Ossetia. Even the most rabidly anti-Georgian reports by Russian state news outlets do not justify the claim. Then there was Medvedev's paranoid aside that seemed lifted out of an old Soviet script: his claim that the U.S. is bootlegging caches of arms into Georgia: "What the Americans call humanitarian cargoes -- of course, they are bringing in weapons," he told the BBC. He added graciously, "We're not trying to prevent it." And then Putin continued the paranoid thread on CNN, claiming that "someone in the United States created this conflict to stir up the situation and to create an advantage for one of the candidates" running for president. Lord knows what Putin and Medvedev think Cindy McCain, who also dropped by Tbilisi this week, had hidden in her clutch purse.

Second, Russia remains a land where the state is willing to enhance its power through the extrajudicial punishment -- to the point of murder -- of its own citizens.</blockquote>]]></description>

We know that it massed at the "border" between Georgia and Ossetia a considerable military and paramilitary logistical presence. We know the Russians had methodically repaired the railroad tracks that the troop-transport trains were to take, and we know that at least 150 tanks went through the Roky tunnel separating the two Ossetias the morning of Aug. 8. In other words, no one can ignore the fact that President Saakhashvili only decided to act when he no longer had a choice, and war had already come. In spite of this accumulation of facts that should have been blindingly obvious to all scrupulous, good-faith observers, many in the media rushed as one man toward the thesis of the Georgians as instigators, as irresponsible provocateurs of the war.

We must re-examine all of this. We must analyze in greater depth the mechanisms of a blindness that may, if we are not careful, perpetuate the Western "decline in courage" denounced in his time by Alexander Solzhenitsyn, but which we thought belonged to the past. Reason, if not honor, demands that we go to the rescue of Europe in Tbilisi.</blockquote>]]></description>

During the Georgian national anthem, the speaker system broke down and tens of thousands of Georgians movingly sang that song without music -- a song that had been illegal to sing under Soviet occupation.

It is shocking to imagine those joyful people now bombed, fearful and occupied.

At the same event, an assassination attempt was made against President Bush. A man threw a grenade wrapped in a handkerchief. Bush was behind a bulletproof shield but within the blast radius of the weapon. 		<description><![CDATA[<strong>The Irish Times </strong>Saturday, August 16, <br /><br />JASON CORCORAN in Moscow<br /><br />EIGHT Irish passport-holders are nervously waiting in a hotel in the Armenian capital of Yerevan before deciding whether to return to Georgia.<br /><br />The group, mainly Georgians with Irish passports and some Irish nationals, were among 50 people evacuated via the Armenian border at Gugeti when fighting broke out in South Ossetia.<br /><br />Kerryman Dr Mike McCarthy, who runs the International Medical Support Services (IMSS) clinic from Tbilisi, assisted in evacuating the Irish and Georgian passport-holders by helping with transport and logistics through the eastern side of Georgia to Armenia.<br /><br />"The people evacuated were going to come back, but the reports about renegade Ossetian militia looting near the capital have spooked them.<br /><br />"Most of the other Irish and passport-holders have made their way back to Ireland or gone on holiday," said Dr McCarthy.<br /><br />His wife's Georgian family mostly live in the bombed port of Poti and have been affected.<br /><br />"Her cousin was killed and another cousin was badly injured when the Russian attack helicopters bombed Poti. She hasn't been able to reach her father since the first bombs fell a week ago."<br /><br />Telephone and mobile communication in Georgia has been difficult. Dr McCarthy's wife Nina, who is seven months pregnant, was supposed to go to Ireland for the birth but will not move until she hears news of her father.<br /><br />Dr McCarthy's IMSS clinic, which employs expatriate and internationally-trained Georgian doctors to service foreign embassies and the oil and gas industries, has been providing help to the capital's overwhelmed hospitals.<br /><br />"We have appealed directly to the Americans here and Micheál Martin to provide aid and basic medicine," said Dr McCarthy, who first came to Georgia 11 years ago to work on a major oil project.<br /><br />"Poti is bombed back to the last decade, Gori is flattened and life in Tbilisi remains okay. All just as the economy was outperforming India; it has now been blown to bits," said the doctor, who has had to cut his 20 medical staff to a skeleton crew of eight.<br /><br />Fellow Irishman Jeffrey Kent runs a contracting firm in Georgia which drills for gold and copper on behalf of a Russian company, and had to evacuate his Romanian drillers via Armenia.<br /><br />He said: "I had to get the Romanian guys evacuated last Friday by crossing the border into Armenia. As they were passing a military airfield at Marneuli near the border some Russian Mig planes just dropped in and bombed the runway. They were only 300m from the explosions and did not get injured, but they were very traumatised. They are in Romania now and do not want to come back." <br /><br />Originally from Terryglass, Co Tipperary, Mr Kent is a contractor for a Russian miner in the town of Kazreti, about a 90-minute drive from Tbilisi.<br /><br />"I will stay here and work from here until things settle down. 		<description><![CDATA[Although the dust is far from settled in Georgia, and indeed I am getting firsthand reports of ongoing Russian troop movements, we will soon have to begin taking a serious look at the international law implications of this military action, and ask some tough questions about 1) the legal status of South Ossetia and Abkhazia pre- and post-conflict, 2) the status of Russia's "peacekeeping" mission and their range of duty, and 3) the legal basis for the deployment of Russian troops into Georgian sovereign territory.

Although the Kremlin PR machine sputtered and coughed in the early days of the war, things are really catching up now (there are <a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/08/14/AR2008081401360.html">three</a> <a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/08/14/AR2008081403048.html">separate</a> <a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/08/14/AR2008081403053.html">articles</a> attacking the Georgian cause in the Washington Post alone today).  However one of the earliest and most important pieces was a by-lined article by Russia's Foreign Minister Sergei Lavrov published in <a href="http://www.ft.com/cms/s/0/7863e71a-689e-11dd-a4e5-0000779fd18c.html">the Financial Times</a> back when Gori was still burning, outlining the Russian legal view on the invasion.  Lavrov's piece argues the following:  "<em>Russia responded to this unprovoked assault on its citizens by launching a military incursion into South Ossetia. No country in the world would idly stand by as its citizens are killed and driven from their homes. Russia repeatedly warned Tbilisi that it would protect its citizens by force if necessary, and its actions are entirely consistent with international law, including article 51 of the UN charter on the right of self-defence.</em>"

However, can the Russians successfully describe the war as a humanitarian intervention?  Article 51 states that nothing "shall impair the inherent right of individual or collective self-defence if an armed attack occurs" - meaning that Lavrov appears to be implying that South Ossetia comprises part of the Russian Federation, and that the only goal of the military incursion into Georgia was the protection of Russian citizens.  The charge of "ethnic cleansing" therefore becomes essential to the Russian legal position.

With these questions in mind, I had a chat with one of the <a href="http://www.brill.nl/default.aspx?partid=75&#38;pid=27878">world's foremost expert</a> on international criminal law and peacekeeping missions (and <a href="http://www.amsterdamandperoff.com/knoops.html">an affiliate of my law firm</a>) Geert Jan Alexander Knoops, who has testified before the international criminal court on Rwanda and the Supreme Court on Hamdan vs. Rumsfeld, to get an idea of his view of the status of the Russian case for war.  ]]></description>

The war between Georgia and Russia has <a href="http://www.iht.com/articles/ap/2008/08/15/europe/EU-Running-From-War.php">reportedly</a> uprooted more than 100,000 people.  Georgia said Russian troops still control one-third of the country, and that the Russian army has brought in “<em>thousands and thousands of irregulars</em>” who are <a href="http://www.bloomberg.com/apps/news?pid=newsarchive&#38;sid=aKebTpaIeE1U">terrorizing</a> the country.  Humanitarian aid groups and UN monitors are <a href="http://ap.google.com/article/ALeqM5iVVNqxAjbWBpCIkTka8nXWNun12AD92IBQK80">reportedly</a> unable to reach large parts of Georgia due to insecure conditions, and Human Rights Watch says it has <a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/08/15/AR2008081500632.html">evidence</a> that Russia used cluster bombs in civilian areas of Georgia.  Russia’s claims of “<em>genocide</em>” in South Ossetia are <a href="http://online.wsj.com/article/SB121874784363742015.html?mod=hpp_europe_pageone">coming under question</a>.  

In the eyes of Russian citizens, their country is “<em><a href="http://www.nytimes.com/2008/08/15/world/europe/15russia.html?scp=13&#38;sq=russia&#38;st=nyt">the peacemaker</a></em>”.  Vitaly Churkin, Russia’s UN Ambassador, says that Georgia’s strategic city of Gori should not be classified as being “<em>in ruins</em>” because it still has <a href="http://www.russiatoday.com/news/news/29033/video">running water</a> and electricity, and classifies Russian troop action there as “<em>humanitarian</em>”.  Russian troops are again <a href="http://www.timesonline.co.uk/tol/news/world/europe/article4535257.ece">stationed</a> in the city, having previously <a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/08/14/AR2008081400779.html">retreated</a>, and journalists are <a href="http://www.telegraph.co.uk/news/worldnews/europe/georgia/2562984/Journalists-come-under-attack-in-Georgia.html">reportedly</a> coming under fire there.  ]]></description>

Power utility RusHydro <a href="http://www.reuters.com/article/rbssUtilitiesElectric/idUSLE69805920080814">reported</a> a 40% year-on-year rise in net profit for the first half of 2008.  If the anti-monopoly agency gets its way, Gazprom may be <a href="http://www.reuters.com/article/rbssEnergyNews/idUSLE6151020080814">forced to share</a> export pipelines with independent producers.  ]]></description>
