NetFlix Inc.’s (NFLX) third-quarter adjusted earnings outperformed the Zacks Consensus Estimate of 45 cents per share. The company announced a 44.9% increase in non-GAAP net income to $32.1 million or 55 cents per share for the quarter, up from $22.1 million or 36 cents per share in the same quarter a year ago.   However, net income fell 6.9% from $34.4 million or 58 cents per share in the last quarter. This was due to sequentially higher operating expenses in the quarter, which were up 13%. Operating expenses, as a percentage of revenues, stood at 23.3% in the quarter versus 21.2% in the previous quarter.   Yesterday in a speech, Federal Communications Commission (FCC) Chairman Julius Genachowski has recommended a new rule to apply net neutrality to all telecom and cable service providers. Net neutrality will prohibit internet service providers (ISP), especially the phone and cable companies, from discriminating against users or applications. ISPs must grant consumers equal access to all legal web applications and services. The rule was so far applicable to the wired services providers, but the new proposal from the FCC wants to bring the flourishing wireless industry under scrutiny. The FCC’s new proposal is, in general, bad news for large telecom and cable operators like AT&T (T), Verizon Wireless (VZ), T-Mobile, a division of Deutsch Telekom (DT) and Comcast Corp. (CMCSA). The satellite television provider TiVo Inc. (TIVO) is a pioneer in digital video recording (DVR) technology. The company won a patent infringement lawsuit against EchoStar Communications Corp (SATS), the parent company of Dish Network Corp. (DISH). Under the 5-year multimedia patent infringement, TiVo has been awarded a sanction of $200 million ($110 million in damages and $90 million in sanctions in addition to attorney fees) from the U.S. District Court in the Eastern District of Texas.  Dish was spun off from EchoStar in 2008.
